2 General Use of the Website

2.1 Access data

We collect information about you when you use this website. We automatically collect information about your usage behavior and your interaction with us and record data about your computer or mobile device. We collect, store, and use data about every access to our online offering (so-called server log files). Access data includes the name and URL of the file accessed, a username if authentication takes place, the date and time of the request, the size of the request and the server response, the message about successful retrieval (HTTP response code), browser type and version, operating system, referrer URL (i.e. the previously visited page), IP address, and the actual request of the visitor.

We use this log data without any attribution to your person or other profiling for statistical evaluations for the purposes of operation, security, and optimization of our online offering, as well as for the anonymous recording of the number of visitors to our website (traffic) and the scope and type of use of our website and services. On the basis of this information, we can provide personalized and location-based content and analyze the data traffic, find and correct errors, and improve our services. We reserve the right to subsequently check the log data if, on the basis of concrete indications, there is a legitimate suspicion of unlawful use. We store IP addresses for a limited time in the log files if this is necessary for security purposes. We also store IP addresses if we have a concrete suspicion of a criminal offense in connection with the use of our website.

2.2 E-mail contact

If you contact us (e.g. via the contact form or by email), we store your information to process the request and in case follow-up questions arise. We only store and use further personal data if you consent or if this is legally permissible without specific consent.

2.3 Google Analytics

Auf unserer Website verwenden wir Google Analytics, einen Webanalysedienst der Google Ireland Limited („Google“). Die Nutzung umfasst die Betriebsart „Universal Analytics“. Hierdurch ist es möglich, Daten, Sitzungen und Interaktionen über mehrere Geräte hinweg einer pseudonymen User-ID zuzuordnen und so die Aktivitäten eines Nutzers geräteübergreifend zu analysieren.

Grundlage für die Nutzung von Google Analytics ist Ihre ausdrückliche Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO. Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Irland) ist unser Auftragsverarbeiter. Wir haben mit Google einen entsprechenden Vertrag zur Auftragsverarbeitung geschlossen. Google verarbeitet Daten teilweise in den USA. Die Übermittlung erfolgt auf Grundlage von Standardvertragsklauseln.

2.4 Google Ads

Wir setzen „Google Ads“ ein. Dabei handelt es sich um einen Dienst der Google Ireland Limited, Google Building Gordon House, Barrow St, Dublin 4, Irland (nachfolgend bezeichnet als „Google“), welcher uns ermöglicht, mit Hilfe von Werbemitteln auf externen Webseiten auf unsere attraktiven Angebote aufmerksam zu machen. Grundlage für die Nutzung von Google Ads ist Ihre ausdrückliche Einwilligung gemäß Art. 6 Abs. 1 lit. a DSGVO. Durch Google Ads lässt sich der Erfolg einzelner Werbemaßnahmen ermitteln. Google liefert diese Werbemittel über sogenannte „AdServer“. Hierfür werden AdServer-Cookies eingesetzt, durch die bestimmte Parameter zur Erfolgsmessung, wie Einblendung der Anzeigen oder Klicks durch die Nutzer, gemessen werden können. For processing operations in which we obtain consent for a specific processing purpose, Article 6(1)(a) GDPR serves as the legal basis.

For the processing of personal data necessary for the performance of a contract, Article 6(1)(b) GDPR serves as the legal basis. This is the case, for example, when data of the data subject is required for the provision of a service or for the implementation of contractual measures.

If the processing of personal data is necessary for the fulfilment of a legal obligation — such as the fulfilment of tax obligations — the processing is based on Article 6(1)(c) GDPR.

Finally, processing operations may be based on Article 6(1)(f) GDPR. This article serves as the legal basis for processing operations where processing is necessary to safeguard a legitimate interest of our company, provided that the interests, fundamental rights, and fundamental freedoms of the data subject do not override this. Our interests in data processing include, in particular, ensuring the operation and security of the website, examining the manner in which visitors use the website, and simplifying the use of the website.

Unless specifically stated, we only store personal data for as long as is necessary to fulfil the purposes pursued.

3.2 Right to rectification (Article 16 GDPR)

You have the right to obtain from us, without undue delay, the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed – including by means of providing a supplementary statement.

3.3 Right to erasure („right to be forgotten“ Article 17 GDPR)

You have the right to obtain from us the erasure of personal data concerning you without undue delay, and we are obliged to erase personal data without undue delay where one of the following grounds applies:

The personal data is no longer necessary for the purposes for which it was collected or otherwise processed.
You withdraw your consent on which the processing was based according to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR, and there is no other legal basis for the processing.
You object to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Article 21(2) GDPR.
The personal data has been unlawfully processed.
The erasure of the personal data is necessary for compliance with a legal obligation under Union or Member State law to which we are subject.
The personal data was collected in relation to the offer of information society services referred to in Article 8(1) GDPR.

3.4 Right to restriction of processing (Article 18 GDPR)

the accuracy of the personal data is contested by you, for a period enabling us to verify the accuracy of the personal data,
the processing is unlawful and you oppose the erasure of the personal data and request the restriction of its use instead,
we no longer need the personal data for the purposes of processing, but it is required by you for the establishment, exercise, or defense of legal claims, or
you have objected to processing pursuant to Article 21(1) GDPR pending verification whether the legitimate grounds of our company override yours.

3.5 Right to data portability (Article 20 GDPR)

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format, and you have the right to transmit this data to another controller without hindrance from us, provided that

the processing is based on consent pursuant to Article 6(1)(a) GDPR or Article 9(2)(a) GDPR or on a contract pursuant to Article 6(1)(b) GDPR, and
the processing is carried out by automated means.
When exercising your right to data portability pursuant to paragraph 1, you have the right to have the personal data transmitted directly from us to another controller, where technically feasible.

3.6 Right to object (Article 21 GDPR)

You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is based on Article 6(1)(e) or (f) GDPR; this also applies to profiling based on these provisions. We will no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or unless the processing is for the establishment, exercise, or defense of legal claims.

Where personal data is processed by us for direct marketing, you have the right to object at any time to the processing of personal data concerning you for such marketing; this also applies to profiling to the extent it is related to such direct marketing.

You have the right, on grounds relating to your particular situation, to object to the processing of personal data concerning you for scientific or historical research purposes or statistical purposes pursuant to Article 89(1) GDPR, unless the processing is necessary for the performance of a task carried out in the public interest.

3.7 Automated decisions including profiling (Article 22 GDPR)

You have the right not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning you or similarly significantly affects you.

3.8 Right to withdraw consent under data protection law (Article 7(3) GDPR)

You have the right to withdraw consent to the processing of personal data at any time.

3.9 Right to lodge a complaint with a supervisory authority (Article 77 GDPR)

You have the right to lodge a complaint with a supervisory authority — in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement — if you believe that the processing of personal data concerning you is unlawful.

4 Data Security

We strive to ensure the security of your data within the framework of applicable data protection laws and technical possibilities.

Your personal data is transmitted to us in encrypted form. We use the SSL (Secure Socket Layer) coding system, but note that data transmission on the internet (e.g. when communicating by email) can have security gaps. Complete protection of the data from access by third parties is not possible.

To secure your data, we maintain technical and organizational security measures that we continuously adapt to the state of the art.

We also do not guarantee that our offering will be available at all times; disruptions, interruptions, or outages cannot be ruled out. The servers we use are regularly and carefully backed up.

5 Automated Decision-Making

Automated decision-making based on the personal data collected does not take place.

6 Disclosure of data to third parties, no data transfer to non-EU countries

In principle, we use your personal data only within our company.

If and to the extent that we engage third parties in the fulfilment of contracts (e.g. logistics service providers), they receive personal data only to the extent that the transmission is necessary for the corresponding service.

In the event that we outsource certain parts of data processing („commissioned processing“), we contractually oblige processors to use personal data only in accordance with the requirements of the data protection laws and to ensure the protection of the rights of the data subject.

Bei der Nutzung bestimmter Dienste von Google kann eine Übermittlung personenbezogener Daten an Server der Google LLC in den USA erfolgen. Diese erfolgt auf Grundlage des EU-US Data Privacy Framework bzw. geeigneter Garantien gemäß Art. 46 DSGVO.

7 Eingesetzte Dienste, Tools und Plugins

Zur Bereitstellung, zum sicheren Betrieb und zur Optimierung unserer Website kommen verschiedene Dienste und WordPress-Plugins zum Einsatz. Nachfolgend erläutern wir, welche Daten dabei jeweils verarbeitet werden und auf welcher Rechtsgrundlage dies geschieht.

7.1 Kontaktformulare (Contact Form 7) mit Honeypot-Schutz

Wir setzen das Plugin Contact Form 7 ein, um Ihnen die Kontaktaufnahme über Formulare zu ermöglichen. Beim Absenden eines Formulars werden die von Ihnen eingegebenen Daten (z. B. Anrede, Name, Firma, Anschrift, E-Mail-Adresse, Telefonnummer, Betreff und Nachricht) per E-Mail an die von Ihnen ausgewählte Fachabteilung übermittelt. Eine Speicherung der Formulareinträge in einer Datenbank durch Contact Form 7 selbst findet nicht statt; die Daten werden ausschließlich per E-Mail versandt und in unserem Posteingang gespeichert. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, sofern die Kontaktaufnahme der Anbahnung eines Vertragsverhältnisses dient.

Zum Schutz vor automatisierten Spam-Einträgen setzen wir zusätzlich ein sogenanntes Honeypot-Verfahren ein. Dabei wird ein für menschliche Nutzer unsichtbares Eingabefeld in das Formular eingebunden, das nur von automatisierten Bots ausgefüllt wird. Wird dieses Feld ausgefüllt, gilt die Eingabe als Spam und wird verworfen. Bei diesem Verfahren werden keine personenbezogenen Daten erhoben, gespeichert oder an Dritte übermittelt. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse am Schutz vor automatisiertem Missbrauch).

7.2 WP Rocket (Caching und Performance)

Zur Beschleunigung des Seitenaufbaus setzen wir das Caching-Plugin WP Rocket der WP Media SAS, Frankreich, ein. WP Rocket erstellt vorgenerierte HTML-Versionen unserer Seiten und liefert diese bei Folgeaufrufen wesentlich schneller aus. Für den korrekten Betrieb kann WP Rocket technisch notwendige Cookies setzen (z. B. wp-rocket-cache), die ausschließlich der reibungslosen Auslieferung der zwischengespeicherten Inhalte dienen. Eine Erhebung, Speicherung oder Weitergabe personenbezogener Daten findet durch WP Rocket nicht statt. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einer performanten und nutzerfreundlichen Website).

7.3 Google Maps

Auf einigen Unterseiten unserer Website binden wir das Kartenmaterial des Anbieters Google Maps ein. Betreiber ist die Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland. Beim Aufruf einer Seite mit eingebundener Karte stellt Ihr Browser eine direkte Verbindung zu den Servern von Google her; dabei wird mindestens Ihre IP-Adresse an Google übertragen. Eine Übermittlung weiterer Daten (z. B. Geräteinformationen oder Standortdaten) ist möglich. Wir laden Google Maps grundsätzlich erst nach Ihrer aktiven Einwilligung über unser Cookie-Banner. 7.4 AWEOS DSGVO Adjustments

Auf unserer Website ist das Plugin AWEOS DSGVO Adjustments aktiv. Es nimmt datenschutzfreundliche Voreinstellungen vor — beispielsweise das Anonymisieren von IP-Adressen innerhalb angebundener Statistik-Dienste sowie das Entfernen externer Ressourcen, die für den Betrieb nicht zwingend erforderlich sind. Das Plugin verarbeitet keine eigenen personenbezogenen Daten und sendet keine Daten an Dritte.

7.5 Schutz von E-Mail-Adressen vor automatisierter Auswertung

Zum Schutz vor automatisierter Auswertung durch sogenannte Email-Scraper-Bots verarbeitet ein serverseitiges Erweiterungs-Modul der AWEOS GmbH alle auf unseren Seiten angezeigten E-Mail-Adressen, bevor sie an Ihren Browser ausgeliefert werden. Die Adressen werden dabei in eine maschinenlesbare HTML-Zeichen-Kodierung (HTML-Entities) umgewandelt. Für Sie als Nutzer/-in werden die Adressen weiterhin völlig normal als anklickbarer Link dargestellt; einfache, automatisierte Adress-Sammler-Programme können sie jedoch nicht direkt auslesen. Dieses Verfahren erfolgt ausschließlich auf unserem Server; es werden hierbei keine zusätzlichen personenbezogenen Daten erhoben, gespeichert oder an Dritte übermittelt. Rechtsgrundlage ist Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse am Schutz vor automatisiertem Missbrauch von Kontaktdaten).
